Vidyard Content Sharing Policy

Buildscale, Inc., d/b/a Vidyard, and our subsidiaries and affiliates (collectively, “Vidyard,” “we” or “us”) provide a business video platform service that helps businesses transform communications and sales through the use of online video. This Content Sharing Policy applies to users outside of the United States who consent to the Sharing of your Customer Content, including any personal data contained therein, to third parties for the purposes of training, testing and improving AI technologies and models. Your consent is entirely voluntary and can be withdrawn at any time, as described below. For further details as to how we handle and process personal data, please refer to our Privacy Policy, in addition to this Content Sharing Policy.

This Content Sharing Policy does not apply to users in the United States. If you are in the United States, please review our Privacy Policy, California Privacy Notice and Self-Serve Terms for the terms and conditions applicable to your use of the Self-Serve Services. This Content Sharing Policy may be updated by us from time to time and will become effective on the date such update is posted. If we make a change to this Content Sharing Policy that, in our sole discretion, constitutes a material change, we will provide you with advance notice appropriate under the circumstances, which may include displaying a notice within the Self-Serve Services or sending an email to the contact information associated with your Account.

“Share” or “Sharing” means any disclosure, transfer, license, sale, or monetization of, or other provision of access to, Customer Content (including related data and metadata) to any third party or affiliate. Capitalized terms used but not defined in this Content Sharing Policy have the meanings given to them in theSelf-Serve Terms.

Vidyard offers a Free Plan to users, subject to the Self-Serve Terms. If you sign up to a Free Plan, you also have the option to access additional features for free by consenting to allow Vidyard to Share your Content with the third parties listed here, including to train, test and improve their AI technologies and models (hereafter “Training and Development Purposes”). By providing such consent, you acknowledge and agree that Customer Content may be Shared for Training and Development Purposes without any compensation to you.

Providing us with consent is completely optional, and comes with the benefit of receiving access to the additional features, but if you choose not to provide your consent you can still access the Self-Serve Services generally available in our Free Plan.

You can withdraw your consent to any further Sharing of your Content at anytime in the “Data and Privacy” section of your Account profile. If you withdraw your consent to Vidyard’s Sharing of your Content for Training and Development Purposes, Vidyard will no longer Share your Content for Training and Development Purposes, but this will not affect any Content previously sold by Vidyard on the basis of your consent. In addition, after you withdraw your consent you will no longer have access to the additional features (including the ability to create new Content using custom avatars), but this will not affect any existing videos that you have already created using the additional features.

If you would like to access custom avatars without allowing your Content to be sold to third parties for Training and Development Purposes, you can always subscribe to a Paid Plan (for more information about Vidyard’s Paid Plan features, please see our pricing page here ).

Your access to and use of the additional features as part of your Free Plan is subject to this Content Sharing Policy the Vidyard Self-Serve Terms and our Privacy Policy.

BY AGREEING TO THIS CONTENT SHARING POLICY, YOU ARE VOLUNTARILY CONSENTINGTO ALLOW VIDYARD TO SHARE YOUR CONTENT WITH THIRD PARTIES FOR TRAINING ANDDEVELOPMENT PURPOSES BY THESE THIRD PARTIES.
